New Law Gives Some New Jersey Residents Chance to Clear Criminal Record

criminal record expungement anthony carboneA new law recently took effect this week that allows the majority of offenders in New Jersey who’ve completed a court-order drug treatment program to have their criminal record expunged. In addition, the law cuts the amount of time New Jersey residents have to wait to clear their criminal record from 10 years to five.

According to news articles, convicted drug dealers would only be eligible for this new law if they were found in possession of 25 grams or less of marijuana or 5 grams or less of hashish.

The change in law is to give low-level offenders such as drug users who have acknowledged committing a crime a chance at a new life. Currently, with a conviction on your record, it can be impossible to find a new job. But now, a reformed drug addict can now have the opportunity to get a good-paying job and gain a good life.

According to New Jersey law, employers have the right to obtain any information about your criminal background in an effort to determine your qualifications for employment. Yet according to Title VII of the Civil Rights Act of 1964, employers cannot discriminate if you have a criminal past. But this does not stop employers from denying employment.

Those who have been convicted of serious crimes, such as murder, sexual assault, or robbery, still cannot have their record expunged.
