Grandparent Visitation and Custody

All responsible family members should have an opportunity to see their loved ones, including grandparents. If you are the grandparent of a child being denied visitation, want to request additional visitation, or would like to obtain custodial rights of your grandchildren, it is important to have an experienced attorney like Anthony Carbone who knows the law and will fight for your rights.

The court recognizes that there is a difference between petitioning for visitation with a grandchild and asking for custody of a grandchild. In a recent New Jersey court case where a Plaintiff appealed from the denial of reconsideration of an order denying her request for grandparent visitation with her granddaughter under the Grandparents and Siblings Visitation Statute, the New Jersey Supreme Court ruled that “the best interest standard was inapplicable in making the determination whether a grandparent could obtain visitation. (Abuse) allegations may be a basis for seeking custody, but plaintiff withdrew her request for custody. She is instead seeking grandparent visitation, for which the showing of harm is different. Thus, the judge did not abuse his discretion in denying the motion.”
