What happens if you’re working while on workers’ compensation?

So you got into an accident at work and you injured your back. You were awarded workers’ compensation. Then one day, you are asked by a friend to do some side work for him. Since you have a little free time while you are recuperating, then there’s no reason why you shouldn’t be able to help your friend, right?

Wrong. Since you are unable to perform at your regular job because of this injury, then you cannot, under the law, obtain another job. In fact, if you do take another job and you fail to report the income, you could be sued in either civil or criminal court. This scenario is called workers’ compensation fraud. The reason it is considered fraud is that, according to the law, you had made a false statement or are concealing information in order to receive workers’ compensation.

Now if you are doing something, like moving a friend’s couch, you won’t get in trouble (although you should really check with your doctor). It’s only if you are making another income somewhere else. However, if your doctor has given permission to do light work while on workers’ compensation, then by law your employer can give you light tasks to do while you are on workers’ compensation. So how can you earn money while on workers’ compensation? While, unless you are receiving permanent partial disability benefits, you can claim unemployment benefits while you are recuperating. It’s a tricky law and we want to help you get through it.
