When You Have Concerns About a Nursing Home

nursing home abuse in New Jersey anthony carboneSometimes it is inevitable.  When your loved one is no longer able to suitably maintain independence, it may be necessary to consider institutionalized care.  This might mean something low key such as an assisted living facility or require more intensive intervention.  Nursing home concerns are a reality, particularly as the baby boomer population ages.

Who Oversees Nursing Homes?

The New Jersey Department of Health oversees nursing homes through its Division of Health Facilities Evaluation and Licensing.  The Division is not just in charge of licensing facilities; it also evaluates them and conducts regular inspections.  Complaints about particular nursing homes are handled by this state agency.

Investigations of Abuse and Neglect

If you report instances of abuse and neglect involving an individual over age 60, claims will be investigated by the New Jersey Office of the Ombudsman for the Institutionalized Elderly.  Older people are considered vulnerable members of New Jersey’s population.  In 2014, the office acted as an advocate for 5,009 New Jersey residents confined to long term care facilities.  A great number of the requested investigations were initiated as a result of complaints from current or former nursing home staff members.

What are Nursing Home Concerns?

Some examples of nursing home concerns are more obvious than others.  Obviously, if your loved one suddenly has unexplained bruises or broken bones, the cause should be investigated.  Bed sores can be avoided and are indicative of neglect in many cases.

At the Law Offices of Anthony Carbone, we have assisted families concerned about the care received by their loved ones.  Some of the complaints we have handled included:

What Should You Do if You Suspect Abuse or Neglect?

Many of our clients fear the prospect of retribution for reporting their nursing home concerns.  This is the reason that we suggest seeking legal advice prior to embarking on a request for investigation.  As nursing home advocates, we are familiar with the procedure and can assist you in your quest to keep your loved one safe.

Prior to making a formal report, we suggest that our clients speak with us regarding the necessary steps to filing a complaint.  We also help in the investigation of any and all claims.  While some nursing home accidents may be unavoidable, many are a result of improper care and neglect.
