Do I get workers’ compensation after being assaulted on the job?

Workplace Violence Workers' Compensation anthony carboneWhen we think of someone getting hurt on the job, we generally think of someone getting into an accident. But sometimes, you can get hurt by the hands of a co-worker. And when that happens, you may be wondering who will pay your medical bills.

Did you know that more than 2 million workers are victims of workplace violence each year? You would think that your job is a place of professionalism. Sure every now and then, the stress may get to someone and he/she will lash out, but violence? Not at your office.

But it does happen. Workplace violence is generally considered an assault and the littlest thing can set someone off.  For instance, let’s say you are having an argument with a co-worker that becomes violent. The next thing you know, the co-worker hits you in the face, breaking your nose. The co-worker continues to assault you until someone is able to intervene. You are taken to the hospital to treat your wounds. Now what?

If you are assaulted by a co-worker while in the workplace, you may be entitled to workers’ compensation under New Jersey law. These benefits include any medical and therapy bills you may need, plus out-of-pocket expenses such as medications. If you need to take time off of work, then your workers’ compensation benefits should pay for two-thirds of your wages lost.

But that may not be all you can do in this case. You can also file a third-party lawsuit against the employer for allowing this type of violence to occur in the workplace. In addition, criminal charges may be pressed against your co-worker.
