Who is Responsible for my Injuries After a Bar Fight?

The brawl began at a New York City bar before spilling out into the street. Two were injured during the fracas. Although many can say fights like this don’t happen too often, it does bring up an interesting question: Can the victims sue for personal injury? And if so, who is responsible?

If you were a victim of a bar fight that you did not participate in, then yes you can sue for any personal injury. However, you can sue not just one person or entity — several people can be responsible for your injuries. The first person who is liable for your injuries is the person responsible for the fight. So someone had hit you over the head with a beer bottle during the fight, then not only will that person face criminal charges but is the one you will be suing.

But that’s not the only person you can sue. Another responsible person is the instigator of the fight, if he/she is different than your assailant. You can also sue the bar owner as well. As premises liability tells us, it is the responsibility of the bar owner to keep the establishment free of danger. Before the fight even began, the employees of the bar should have stepped in to prevent the fight from occurring. In addition, it is the duty of the bar owner to keep the bar patrons safe from harm. If there’s no security, such as a bouncer, than this is a case of negligent security.
