Do you get workers’ compensation as an Uber driver?

In New Jersey, Uber has become a power house as the organization recently announced that it wants to recruit 13,000 new drivers by the end of the year. Although there have been attempts by lawmakers to regulate ride sharing programs, it seems that Uber is here to stay.

But what happens if you get hurt while driving for Uber? We’ve mentioned before that Uber passengers involved in car accidents may not be covered by insurance, unlike when you ride in a taxi or limo. But let’s say you are an Uber driver. While on the job, you get into a fight with one of your passengers. Your injuries are severe enough that you have to go to the hospital. Where is the money coming to pay the bills?

Generally, if you were a taxi or limo driver, if you were injured in a fight or a car accident while on the job, workers’ compensation will pay for your injuries. However, the same cannot be said for Uber drivers. Ride sharing employees are considered independent contractors and unfortunately, many of the protections that cover regular employees are not available for these type of workers.

But because you’re considered an independent contractor by the employer does not mean you won’t be covered for workers’ compensation. As mentioned previously, if you are an independent contract, the court has tests that determine your eligibility for workers’ compensation through your employer. This can be a very tricky matter.
