No matter how amicable the divorce is, you still need a lawyer

You and your spouse have decided to get a divorce. You find an agreement on the division of property and since you don’t have kids, it’s all cut and dry. So, you won’t need a lawyer to help you through this divorce, right? Well, no, not exactly.
Before we get into the explanation of why, let’s examine what an uncontested divorce in New Jersey means. When both spouses agree to the following conditions, this means the divorce is uncontested:
- Child custody and visitation
- Child support
- Division of assets and debts
- Any alimony or any other disputes involving marriage
In New Jersey, if your divorce is uncontested, then it will move along much quicker than a contested divorce. Unlike a contested divorce, which can take up to a year, an uncontested divorce can be over as quickly as a month’s time. That’s because you won’t have to worry about pre-trials, negotiations, and mediation sessions as you would with a contested divorce.
But if you and your spouse agree to everything, why get a lawyer? There are still many legal components to an uncontested divorce. You have to file paperwork with the proper court. If it’s not then your case will be dismissed and you will have to start from the beginning. Once you do file the papers at the courthouse, then you have to make sure the paperwork served to your spouse. And once the paperwork has been taken care of, you still have to attend a hearing in court. And we cannot stress it enough – you should always have a lawyer with you whenever you step into a courtroom.
