When your workers’ compensation claim is contested

You go through all the proper steps in claiming your work-related injury. You informed your employer. You saw the doctor. And you filled out the proper paperwork. But then it all goes wrong when your insurance company denies the claim. What do you do now?
It happens more often than not. There are many reasons why a claim is denied. It could be because your employer waits too long to report the injury or because the procedures weren’t followed properly or because there needs to be more proof of your injury. But don’t fret! You can always file an appeal with the New Jersey Division of Workers’ Compensation. But in order to be successful, you should contact us to help with the process. An appeal can get tricky.
Keep in mind that you have 30 days to appeal the decision. When you do file your appeal, also make sure that your paperwork is all in order. You should have a copy of the submitted injury report, along with any receipts and medical visit summaries you have available. Be aware that the appeals process could take several months to complete, possibly long after you have recovered from your injuries.
