As an Illegal Immigrant, Can I Receive Workers’ Compensation?

With President Obama’s plan to distribute work permits to illegal aliens, a curious question comes to mind. As we have stated before, illegal immigrants have the same rights as US citizens when it comes to filing a personal injury claim. But what about workers’ compensation?

All New Jersey workers, whether legal or illegal, are eligible to receive workers’ compensation benefits. This may seem strange, considering that employers who hire illegal immigrants will be fined. But just because you are not a legal citizen, this does not mean you can’t compensation for your injuries. And just like US citizens, illegal immigrants are entitled to the following when filing for workers’ compensation:

  • Payment of your medical bills
  • Receiving temporary disability benefits
  • Or compensation for any injuries that prevent you from working as before

But what if the employer says you are an independent contractor? According to New Jersey law, independent contractors are responsible for their own workers’ compensation insurance and not the employer’s.
