What Is a Slip and Fall Case?

A slip and fall case is when you fell either on a sidewalk, you fell in a store, you fell in somebody’s house as a result of somebody else’s negligence. And the negligence is the critical part because you have to prove that the person owned the property where you fell did something wrong.

Now, I’ll tell you this. I had an argument with my father a couple of months ago and my father was telling me at 91 years old who drove a truck his entire life that he fell and he wants to sue. So I said, “Pop, what did they do wrong?” And he says, “Well, they don’t have to do anything wrong. As long as I fell, I have a case.” “Well, no, you don’t, dad. We have to prove that they did something wrong. What did they do wrong?” “That’s not the law. As long as we fell, we have a case.” “Dad, I got it. I got it. However, I’ve been doing this for 33 years. I think I have little more knowledge on this than a truck driver, a 92-year-old truck driver. So, what did they do that was wrong?” “I’m telling you,” he says, “You just have to prove that you fell.”

Well, my father was wrong. And you have to prove negligence. You have to prove that they did something or they didn’t do something that caused your injury.
